To obtain the warranty coverage stated below, return a defective product with proof of original sale to a Sears, Kmart or other Transform SR Brands Management LLC authorized retailer that sells DieHard vehicle batteries.

Free Replacement Period

During the Free Replacement Period indicated above, if the battery you purchased fails to hold a charge as determined by our testing, we will replace the battery you purchased free of charge. If we installed the original battery as indicated by your copy of the invoice or other evidence acceptable to us, we will install the replacement battery as part of our DieHard Service free of charge. If we did not originally install the battery being replaced or if there is no evidence of the original installation by us, installation, if requested, will be subject to our standard DieHard Service charge. If we replace a battery as provided in this paragraph, the Free Replacement Period applicable to your replacement battery shall be the unexpired portion of the Free Replacement Period relating to the replaced battery.

Proration Period

The Proration Period applies only to a battery that had a prorated warranty at the time of purchase. During the Proration Period, if the battery you purchased fails to hold a charge as determined by our testing, we will give you a credit toward the purchase of a new battery at any Sears Auto Center, Kmart or another store of the Transform SR Holdings LLC family of companies in the U.S. The amount of your credit will be determined by multiplying the unexpired percentage of the original warranty period by the original purchase price of the returned battery or its replacement in our product line (after deducting any trade-in value). If we installed the original battery as indicated by your copy of the invoice or other evidence acceptable to us, we will install the replacement battery as part of our DieHard Service and give you a percentage credit toward our standard DieHard Service charge equal to the battery proration percentage. If we did not originally install the battery being replaced or if there is no evidence of the original installation by us, installation, if requested, will be subject to our standard DieHard Service charge.

Limitations

This battery warranty applies only to the original purchaser and only if the battery is still in the vehicle where it was originally installed.  If you used the battery for commercial use or in any vehicle other than a private passenger car or light truck, the Free Replacement Period will be one-half as long as the period specified above. Full replacement at no charge is not available without proof of original purchase date. This warranty is subject to the General Terms that appear at the bottom of this page.

Exclusions

This battery warranty does not apply to batteries used in vehicles without properly operating starting and charging systems.

How to Make a Claim

To make a claim under the battery warranty described above, you must present your sales receipt or other record indicating the date of purchase at a Sears Auto Center, Kmart or another store in the Transform SR Holdings LLC family of companies in the U.S. that sells vehicle batteries.

General Terms

We make no warranties on any of the products described on this page other than those specified above. We expressly disclaim any implied warranties of merchantability and fitness for a particular purpose. If a parts manufacturer offers a warranty more favorable than the warranty we extend above, we will honor the manufacturer’s warranty. These limited warranties do not provide compensation for loss of time, loss of use of vehicle, inconvenience or consequential damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion may not apply to you.

To obtain the warranty coverage stated below, present the tire with proof of original sale to a Sears, Kmart or other Transform SR Brands Management LLC authorized DieHard tire dealer, along with a tire rotation record showing that the tire was rotated once every 5000 miles or within vehicle manufacturer specifications.

DIEHARD LIMITED WARRANTY

FOR RATED TREADWEAR MILEAGE or SIX YEARS from date of manufacture or FIVE YEARS from date of sale, whichever comes first, this tire is warranted against 1) failure due to defects in material or workmanship or 2) premature wear out (see Rated Treadwear Mileage table below), when it is installed, driven and maintained according to all qualifications, conditions and customer service information listed in this warranty document.

WITH PROOF OF SALE and under the terms set forth below, a new tire will be supplied at no or reduced charge for one that is defective or a credit will be issued for one that is prematurely worn out. You are responsible for all costs associated with tire installation, including mounting and balancing.

To receive warranty coverage, present the tire to an authorized DieHard dealer in the United States along with a tire rotation record showing that the tire was rotated once every 5000 miles or within vehicle manufacturer specifications.

Warranty Qualifications

This warranty applies to the original purchaser of any new DieHard tire and is non-transferable. Eligible tires shall be used on the vehicle on which they were originally installed according to the vehicle manufacturer’s or retailer’s recommendation. This warranty applies if all following qualification requirements are met:

1. The tire was purchased after January 1, 2016.
2. The tire is the size, speed and load rating recommended by the vehicle manufacturer or DieHard dealer.
3. The tire has not become unserviceable due to a condition listed under What is not Covered.
4. The tire is no older than 6 years from the date of manufacture or 5 years from the date of sale, whichever occurs first.
5. The tire is of the type specified for passenger and light trucks.

Warranty Conditions

1. Coverage for material or workmanship defects
   A warranty claim will be considered should any tire become unusable due to a workmanship or material defect during its usable tread life (more than 2/32 inch remaining tread). In all cases described below the applicable taxes on the new tire and cost of mounting, balancing and any other charges in connection with the replacement of the tire are required to be paid by the owner:
   1. During the first 2/32 inch wear of the original usable tread and within one year from date of sale:
      Tire will be replaced with the same or comparable new DieHard tire free of charge.
   2. After the first 2/32 inch of the original usable tread or after one year from date of sale, whichever occurs first:
      Credit will be given to the owner toward the purchase of the same or comparable new DieHard tire. The credit amount will be determined by multiplying the percentage of original tread depth remaining on the tire times a pre-established tire use adjustment price.
   3. During the first 2/32 inch wear of original tread:
      If the tire is out-of-round or exhibits ride complaint it will be replaced with the same or comparable new DieHard tire free of charge.
2. Coverage for premature wear out
   Treadwear mileage is warranted as follows:

   1. If an above eligible tire wears out prematurely, that is, wears down to 2/32 inch remaining depth under normal passenger vehicle use before it is driven the miles specified by its treadwear mileage rating, credit will be given to the owner toward the purchase of the same or comparable new DieHard tire, prorated on remaining warranted miles.
   2. The purchase credit will be calculated by multiplying the percentage of warranted miles remaining times a pre-established tire use adjustment price.
3. What is not Covered
   This DIEHARD LIMITED WARRANTY will NOT pay for tires that:
   1. Are used or serviced outside of the Continental United States, Hawaii or Puerto Rico.
   2. Are damaged by willful abuse or in collision, wreck or fire.
   3. Have continued to be used while flat or severely under/over inflated.
   4. Are damaged by road hazards including but not limited to: puncture, cut, impact break, stone drill, bruise, bulge, snag, collision.
   5. Are prematurely or irregularly worn down due to vehicle mechanical reason or misalignment (a measured tread difference of 2/32 inch or more across the tread on the same tire).
   6. Are damaged due to conditions resulting from improper mounting/demounting, underinflation, improper tire size, improper repair, defect in vehicle, abuse.
   7. Are damaged by ozone or weather cracking on tires that occurs after four (4) years from the date of manufacture.
   8. Exhibit ride disturbance complaints (out-of-round, vibration, pulling, etc.) after 2/32 inch tread wear or 1 year from date of purchase, whichever occurs first.
   9. Have been recapped, retreaded or regrooved.
   10. Have been modified by the addition or removal of material, or any tire intentionally altered to change its appearance.
   11. Are unserviceable due to tire operation in excess of tire or wheel manufacturer specifications and recommendations.
   12. Have been misapplied to vehicle due to undersize, oversize or insufficient speed rating (speed rating must be no more than one below what is recommended by the vehicle manufacturer).
   13. Are unserviceable because of chemical corrosion, vandalism, chain use or flat spotting.
   14. Have less than 2/32 inch remaining depth.
   15. Have the serial number cut or buffed.
   16. Have been used for racing or off road use and misapplication.
   17. Are used while providing commercial services or if rented to another person, or to provide ridesharing services such as Uber or Lyft.

Disclaimer of implied warranties; limitation of remedies

Customer’s sole and exclusive remedy under this limited warranty shall be product replacement as provided herein. Implied warranties, including warranties of merchantability or fitness for a particular purpose, are limited to the effective time periods stated in this warranty, or the shortest period allowed by law. Seller shall not be liable for incidental or consequential damages. Some states and provinces do not allow the exclusion or limitation of incidental or consequential damages, or limitation on the duration of implied warranties of merchantability or fitness, so these exclusions or limitations may not apply to you.

This warranty is void if this product is ever used while providing commercial services or if rented to another person, or to provide ridesharing services such as Uber or Lyft.
